So on that tiny sample space - even the very basics of statistical treatment, an extremely crude sample space is 30 - so below that. You could infer that the being vaccinated has little effect on stopping death.

Define "unvaccinated"...?

If "fully" vaccinated in Israel is two shots and two boosters, then two shots and one boosters is not fully vaccinated therefore goes in the unvaccinated category...

Perhaps Australia is less strict with it's definitions...

And I'm curious what the raw numbers actually are. With high vaccination rates and natural immunity... There has to be a limit to how many unvaccinated can be put into hospital.

Remember when you were all hating on big pharma? If Merck had an existing drug that was a cure for covid they would be shouting it from the rooftops and flogging billions of doses.

So I haven't been following the Novak case today, too busy...but.....

It is reported the Government's argument is that he may attract and promote anti-vax sentiment.

Seems an odd position from the Government after a week of deliberation. Pretty sure they will lose with that argument as Novak is here to play tennis, not give lectures on anti-vax issues. If a principle is set about what other people might do in your name then we are all pretty well stuffed. We can't control what other people use our names for.

If Novak was actively promoting civil disobedience via interviews or giving lectures to fringe groups or something then I get the Government's point but he isn't....he is playing tennis, So I am pretty sure a judge would say that Novak cannot be held accountable for others actions when he does nothing to promote those actions.

Seems weird the Government's position isn't simply one of the basic rule... you have to be vaxxed to enter, or there has to be a valid medical exemption why you can't be vaxxed. Argument would be that the rule isn't that an exemption exists simply because you aren't vaxxed, but only exists if you can't be.

As far as we are aware Novak is only saying he had covid therefore doesn't need to be vaxxed. But 'doesn't need to be' and 'can't' are not the same thing, Any time Novak didn't have covid he could have been vaxxed. He could get vaxxed today, no medical reason why not.

You'd think the Government position would be that he isn't vaxxed not because he can't be for a medical reason but that he has actively managed the situation to not be vaxxed because he doesn't want to be. Having covid meant he couldn't get the jab for a week, but he is a pro tennis player who would always have had the intention of playing in Australia, in a potentially record breaking grand slam, thus could have got vaxxed any other time.

The Government position is then consistent with the original decision and consistent with everything else. It would also put the onus on Novak to prove he can't be vaxxed ever, not just last week when he had covid. The judge then has a simple task to decide if Novak followed the rule or not. Case isn't about whether the rule is right or fair or reasonable, just about whether Novak followed it.

By saying his actions might incite others you are leaving the judge to decide on what might and might not be and how liable Novak is for the actions of others. Can't see that position winning for the Government.

But we'll see very soon...

....and the government will never win with 'he is a covid risk to the community' as clearly one person entering a state that already has 50,000 cases a day isn't a threat.

Yep, OK, so reading the ABC blog on the case :

Djokovic's defence team argues that the Minister failed to consider whether deporting Novak Djokovic would also have an impact on anti-vaccine sentiment in Australia, and thus his decision was illogical, irrational or unreasonable.

They also have told the court the Minister misrepresented media reports in order to over-egg the tennis star's views on vaccines and the level of support he receives from anti-vaxxers.

They argue there isn't enough evidence to find Djokovic's mere presence playing tennis in Australia would excite anti-vaccine sentiment, which was a conclusion reached by the Immigration Minister.

The Minister's lawyer has been arguing against the suggestion that the minister did not consider that deporting Djokovic could foster anti-vax sentiment, in the same way allowing him to stay could.

Stephen Lloyd says the minister was aware there were "consequences each way" but he didn't have to go into all of that in his written reasons.

Mr Lloyd has also said there was enough evidence to draw a conclusion about Djokovic's beliefs, given he is not vaccinated and has had ample chance to change that.



Surely that last bit is the only argument they should have made ?

If the Government's only real argument that his presence may incite... and his lawyer's argument that his deportation is likely to similarly incite ..

I guess maybe the 'opinion of the minister' can be his opinion and can be right or wrong. Law says his opinion is final and so nobody else's opinion really matters. What might or might not be is only relevant within the Minister's opinion and not within anyone's opinion, so it is irrelevant what might or might not reasonably occur, if the minister's opinion doesn't have to legally be reasonable, only has to be his opinion.

Dunno, have to wait a while for hear the judges reasoning.

They didn't rule in favour of the Government's cancellation of his visa, or agree with the government's cancellation or even say that his visa should be cancelled..

They dismissed Novak's appeal against the decision to cancel his visa. They didn't rule the decision to cancel was right, just that Novak's appeal against it wasn't right.
