Dead right FN.
He had a 408 class visa (apparently). That allowed him to play professional sport for a short period of time.
If he had entered Australia and then not played in the Aus Open but gone picking mangos, he would have been in breach of the visa. You can't say "as soon as I get my visa then I'm in and that's it".
I am not sure how it isn't right to say you don't have the visa until that dude in the little glass box stamps your passport and says welcome with a menacing growl on his face and the most frightening uniformed lady you have ever seen stood behind him glaring at you.
If his visa requires proof of entry to the tennis when the application is made then it would seem like he planned to play when he applied for his visa and thus had no intention of being vaxxed.
If his visa doesn't require proof of entry to the tennis when the application is made then where is the argument he had an unconditional visa ? You can't enter on a tourist visa then work, you can't enter on a play professional sport visa and then not play professional sport, you can't enter on a visa and then say "all other requirements are voided by the virtue I have a visa".
The argument about "he had a visa" seems completely nonsense.
But all this was sorted in the first appeal. Technicality or not, his visa cancellation was thrown out and he was validly in the country.
He was then ejected by the Minister because of his "assumed" position is not the same as the Government of Australia on vaccines, and he might encourage people not to get vaccinated. Nothing to do with his visa status.
Ultimately the State has all the power, if they stuff up, then take it on the chin and move on. Our government stuffed up his visa process, got burnt in court for further stuffing up his visa cancellation and then followed that up with a f@rk you anyway we are going to kick you out.
It makes us look dumb, stupid and petty all at the same time. I don't give a toss about him or tennis, this is a disgraceful act from Australia and frankly I am appalled I have a government so rubbish and even more embarrassed so many of my countrymen think it was the right thing to do.
