Mineral, it is an 8,000 million dollar handout. It makes sense to check if it is legal. The lawyers/High Court fees would be insignificant in the greater scheme of things.
The process is important otherwise you have scenarios such as one man taking a democratic country to war without any discussion or vote in Parliment or even Cabinet.
Yep your right if we didn�t have a Westminster system , however we have two houses of parliament and a whole team of l lawyers working for them before the stimulus package was approved

and passed by both houses. The clown was either just grandstanding or had an ulterior motive

I think if you read it closely, the point was not ever about the payments (he pointed out other "legal" ways for the payment to proceed), it was about the legality of whether it was a tax benefit or a gift.
The ATO cannot give you a gift.
There still may be ramifications, because it highlighted the fact that the Commonwealth is actually overstepping its authority, constantly.
I'm not an expert and only listened briefly on the radio, but if you check the constitution etc. apparently the States are supposed to hold most of the power and the commonwealth just binds a few things together, over the years that seems to be being reversed.
