Perhaps not but that's for Altex and the yard to sort out not the poor end user, that's the issue I have with their response. You would expect them to look into the issue and advise where they think it's gone wrong based on some actual facts not just shrug their shoulders, any business I've ever been part of would also be bending over backwards to make a goodwill gesture to keep the customer regardless of who is to blame especially when you're looking at a product where if satisfied that customer will keep coming back till they exit boating.
Altex makes a claim on their website
"No.5 PLUS is the solution to the ever-increasing fouling burden in nutrient-rich waters. No.5 PLUS will typically provide 22-26 months protection.*
(based on two spray-applied coats). "
and
"* Durability will be determined by film thickness applied, frequency of use, water conditions, tidal flow and many other variables"
There is no way a reasonable person would determine that 3 months of protection which is less than 15% of their lowest stated protection being 22 months is reasonable. From first hand experience in challenging these types of issues I'd say there's a less than 10% chance they'd get away with relying their disclaimer when it's been professionally applied and the conditions in which the vessel has been used are not an extreme outlier.

A lot of people forget that marine climates change and an AF that's good for a while can suddenly be useless and a change of AF is required. Port Hacking is a perfect example.
Understood but doesn't change the fact they are potentially misleading consumers.
If I had the time I'd follow it up but work is too busy at the moment. It's not overly hard or expensive to get an outcome e.g. after a few phone calls and emails I got settlement for $1,000 off a telco last week because their online agent made an offer they could not deliver. If people don't hold these companies to account there is no incentive to improve.
