I kinda would have thought it was the kiter as he is riding or setting up for the wave - normally you would expect people heading out to either steer clear of the riding zone (waves) or be aware of where people are - look at the way the poleys do it at Margs - they have a great system in place...
Regardless both should have their eyes open and avoid such instances... looks nasty...
Looks to me like the poley had right of way, the kiter may have thought he had because he thought he was on a wave, well he doesn’t look to me to be riding a wave, not yet, also looking at his bar looks as if he had his kite low (that will please the wake crew) which meant the poley couldn’t sail downwind, least not in the video.
hindsight is lovely but they both should have been prepared to give ground, although the kiter more than the poley in my opinion should of been the one prepared to give way in this instance - a lot of windsurfers cant turn for ****, its more difficult to learn than kitesurfing, that’s what I always keep in mind when they are about.
Its also easy once you’re in the zone on a wave (Or trying to hit the breaking sections of a closed out onshore slop) to forget anyone else is out there, had a few near crashes myself with other kiters.
