So sad to see poor Bolta at the front of the court, all tight lipped and glaring. "Its a sad day for Australia" blah blah blah. Poor fella might have to get used to the idea that he should check his facts first, and not write in bad faith..... poor Bolta.

True, and he can be a wild right winger when the mood takes him, and typical media mouth who thinks we all take notice of the crap they dish up. However some of his claims in the articles were not to far off the mark.Only the ones the aboriginals term Super ..... were the ones doing all the whinging. Must have hit a raw nerve there I reckon.

Many of my family have been prone to this kind of welfare, its welfare, its addiction to welfare, and a corrupt game of welfaring politics to only encourage more of the same, teach a man to fish............(Willcannia mob gonna let you know!)
The reverent crux of the situation is integration, integration will never happen if the boats being rocked unfairly.

Its a case of the elite bro rigies robbing little Keith from Willcannia street of his just deserts, even if he is only 7 and sounds like he smokes a pack of Winnie reds a day.
A Microcosm of the eternal fractal that is humanity ;)
At least from this shiznit with Bolt, today I read Australia makes the next step forward to the absolute right of FREE SPEECH, today we only have implied right, and no constitution, today and until legislation is passed we are ALL literally still convict slaves.

Absolutely.

And while we are at it integration between rich and poor will never happen while we don't tax them at the same rate and the rich don't get all the benefits that poor people do.

It wasn't what Bolt said, it was how he said it.

I'd disagree, panda. I reckon how he said it didn't make any difference. It was what he said.

Basically, he was spreading lies about people. Whether he knew they were lies or not is irrelevant - he's a journalist and so he has the skills and the means and the training to know it's important to check such things. Therefore he should have checked the facts.

His defence was that preventing him from saying such things is somehow a restriction of his freedom of speech. I think if he wants to spread lies about people then the only freedom he has is to wear the consequences. My sincere hope is that the nine now each sue his @rse until his eyes are streaming.

Hope the irony is not lost for people reading this post, Bolt works for one of the most restrictive media organizations in the world, free speech is just that, free from restraint.
, His "free" speech is paid for by that company, just part of a propaganda agenda set by management to further business interests and a right wing zeal I have had from time to time listened to steve price and bolt on a melb radio station often feeling halfway between total bewilderment and neasea at what is being said, in fact listening to that stuff is a great way to relieve constipation , if indeed you suffer from that but I would suggest More fibre is better

Yeah, this is correct. That's kinda what I meant.

What I meant was he is allowed to say "All people be treated equally no matter their colour". He is allowed to question how people identify their race.

Is it a bit odd that someone that is half Aboriginal identify themselves as Aboriginal? See I just said that.

But you can't be saying Joe Bloggs is falsely identifying themselves as black just to profit, [rage rage rage], in a public broadsheet. ...Or something like that.

If you like living here - you're Australian. If you don't like living in Australia - I guess you should move back to Ireland or England - who cares.

Bolt is a Sensationalist and I mistrust him and his newspaper, you must recognise this as the stunt it is; He is just trying to gain kudos for getting freedom of speech through parliament.

Yes. I think Bolt is a twit.
However, the problem is, although Mr Bolt may have got all that he deserves in this ruling, the effects of the ruling extend to a whole lot of people from this time on, who might just making a very fair comment on a situation.
Once a case argued on a particular point is decided in a court of law, that ruling can be quoted as a precedent in any future cases which go before the courts and the point is taken as already proven. That is, the ruling goes into common law.

I think some of what he said is valid and I agree with it. Unfortunately, as is typical these days, he doesn't seem to have researched what he was saying properly so although some of the principles were correct, many of the facts were not.
He should have been challenged and charged on the wrong facts.
What has happened is that the proven error in facts has been used to make an incorrect ruling to outlaw a probably true principle.
I think the ruling should be challenged and put right.
If the people concerned then want to sue his ass for libel then by all means do that and claim compensation. And lots of it.

True, but as usual surprise surprise, most of the media is beating up what the court actually ruled.

The full ruling is here: www8.austlii.edu.au/cgi-bin/viewdoc/au/cases/cth/FCA/2011/1103.html

With the (very!) important point:

Finally, in dealing with the formulation of the orders to be made by the Court, I have observed that it is important that nothing in the orders I make should suggest that it is unlawful for a publication to deal with racial identification, including by challenging the genuineness of the identification of a group of people. I have not found Mr Bolt and the Herald & Weekly Times to have contravened section 18C, simply because the newspaper articles dealt with subject matter of that kind. I have found a contravention of the Racial Discrimination Act because of the manner in which that subject matter was dealt with.
